Welcome to TryChatty.com (“Chatty,” “we,” “our,” or “us”). Chatty provides artificial intelligence-powered customer support solutions designed to enhance customer engagement, automate responses, and streamline customer interactions.

By accessing or using our website and services (the “Services”), you agree to comply with and be bound by these Terms of Use (the “Agreement”). If you do not agree to these Terms, you must discontinue your use of the Services immediately.

2. Eligibility & User Responsibilities

By using Chatty, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.

• You have the legal authority to enter into this Agreement.

• You will use the Services in compliance with all applicable laws, regulations, and these Terms.

3. Account Registration & Security

3.1. Creating an Account

To access certain features of Chatty, you may be required to register for an account. You agree to provide accurate, complete, and updated information during registration and to update such information as necessary to maintain its accuracy.

3.2. Account Security

You are responsible for maintaining the security of your account credentials. Chatty is not liable for any unauthorized access to your account. If you suspect any breach of security, you must notify us immediately at security@trychatty.com.

4. Chatty Services & License

4.1. Grant of License

Chatty grants you a limited, non-exclusive, non-transferable, and revocable license to use our Services for personal or business purposes.

4.2. Usage Restrictions

You agree not to:

• Modify, reverse-engineer, decompile, or disassemble any part of the Services.

• Use the Services for any illegal or fraudulent activity.

• Violate any applicable laws or regulations.

• Exploit AI-generated responses for misleading or harmful purposes.

5. Acceptable Use Policy

You may not use Chatty for:

• Unlawful activities, including fraud, impersonation, or unauthorized access to data.

• Abusive behavior, including harassment, spamming, or hate speech.

• Malicious activity, including the spread of malware or engaging in cyberattacks.

Chatty reserves the right to suspend or terminate accounts that violate this policy.

6. Payment, Subscriptions, & Billing

6.1. Subscription Plans

Chatty offers both monthly and yearly subscription plans, as outlined on our pricing page.

• Monthly Plan: $12.99 per month.

• Quarterly Plan: $9.99 per month (billed every 3 months at $29.99).

• Yearly Plan: $5.99 per month (billed annually at $69.99).

6.2. Payment & Auto-Renewal

• All payments are processed securely through third-party payment providers.

• Your subscription automatically renews unless canceled before the renewal date.

• Chatty reserves the right to change pricing with prior notice.

6.3. Refund Policy

• Subscription fees are refundable only if subscription period has not started or where required by law.

• If you believe you were charged in error, contact hello@trychatty.com within 7 days of the charge.

• If you wish to cancel your subscription you can do so in your Settings -> Billing.

7. AI Limitations & Disclaimers

7.1. No Guarantee of Accuracy

Chatty's AI-generated responses are based on data inputs and machine learning algorithms. We do not guarantee the accuracy, reliability, or completeness of responses.

7.2. No Legal, Financial, or Medical Advice

Chatty does not provide professional advice. AI-generated content should not be considered legal, financial, or medical advice, and you should consult a professional for such matters.

8. Privacy & Data Protection

Your use of Chatty is subject to our Privacy Policy, which governs how we collect, store, and use your data.

• We may collect usage data to improve Chatty's performance.

• We do not sell personal information to third parties.

• You may request data deletion by contacting privacy@trychatty.com.

9. Intellectual Property Rights

9.1. Ownership

All intellectual property, including AI models, software, trademarks, and website content, belongs to Chatty or its licensors.

9.2. User Content License

By submitting content to Chatty, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display such content in connection with the Services.

10. Termination & Account Suspension

10.1. Termination by User

You may cancel your Chatty subscription at any time through your Account -> Settings -> Cancel subscription.

10.2. Termination by Chatty

We reserve the right to suspend or terminate your access to Chatty if:

• You violate these Terms.

• We detect fraudulent or harmful activity.

• Chatty is discontinued or replaced.

11. Limitation of Liability

To the fullest extent permitted by law:

• Chatty is provided “as is” and “as available”, without warranties.

• We are not liable for indirect, incidental, or consequential damages.

• Our liability is limited to the amount paid for Services in the past 12 months.

12. Modifications to Terms

Chatty reserves the right to update these Terms. We will notify users of significant changes via email or website notice. Continued use of Chatty after changes means acceptance of the updated Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Slovakia.

• Any disputes shall first be attempted to be resolved informally.

• If unresolved, disputes shall be settled through arbitration in Bratislava.
